On Justice and Good Faith

The dates below show the timeline about the case between BCDA vs CJHDevCo.

On June 2014Pasay City Regional Trial Court has cleared Camp John Hay Development Corporation Chair and CEO Robert Sobrepeña of estafa case. It was recorded by the Department of Justice (DOJ).

On December 19, 2014, a 7-page request which the Department of Justice got, Pedro Gutierrez, Pasay RTC Branch 119 Judge, denied the advancement to reconsider the completion of the case as recorded by the association prosecutors in light of a true blue sympathy toward Bases Conversion Development Authority that sued Sobrepeña by neglect to satisfy an insurance on the lease understanding he stamped.


And on February 11 2015, the arbitral tribunal issued its Award in the arbitration between CJH Development Corporation (“CJHDevCo”) and the Bases Conversion and Development Authority (“BCDA”).

Baguio is a very attractive place, it's beautiful. Now what do you think will be the outcome once the decision has been granted to case.

Whatever it is, it must be accepted with all their good faith for the benefit of the public.

In the Award, BCDA was requested to come back to CJHDevCo roughly Php1.42 Billion in rentals that it had paid to the BCDA. 

And CJHDevCo was coordinated to abandon the Leased Property and turn it over to the BCDA, with all upgrades that CJHDevCO had presented in that amid the term of the lease. 

In the meantime, neither party can implement the Award, without an order confirming the same and a writ of execution being issued by the court. The writ of preliminary injunction enjoining the BCDA from taking over Camp John Hay remains in full force and effect unless the court orders.

The BCDA is additionally completely mindful that the different properties inside the camp were sub-let to different outsiders in accordance with some basic honesty. 

The BCDA is, actually, in ownership of the different contracts covering these properties and has never raised any protest to them.


With the issuance of this Award, both parties must act in good faith and with due regard for the rights and interests of innocent third parties who are not involved in the dispute between CJHDevCo and the BCDA.
